Scenario

Hopewell Medical Center is an acute care facility with 550 beds in the southwest region of Mississippi. Hopewell employs over 700 physicians and specializes in cardiology, oncology, emergency medicine, women and childbirth care, pediatrics, and more.

In the past few months, the Health Information Management (HIM) Department at Hopewell Medical Center has received over 15 subpoenas and court orders requesting documentation for pending medical malpractice lawsuits. This is quite a surge in the number of subpoena and court order requests and the appropriate officials at Hopewell are investigating the increase. As the HIM Department Director, you are knowledgeable in legal practices surrounding medical services and health information. However, you have noticed that your staff appear very nervous each time a legal request is received. You’ve even heard rumors from your staff that the medical center will close due to all the legal actions.

To alleviate some fears, you have decided to educate your staff about federal regulations and the legal system.

Instructions

Create a PowerPoint presentation to educate staff in the HIM department on federal regulations that impact health information. Use the PowerPoint slides as a visual reference for your audience. The slides should only contain general information. Add speaker notes in the Notes pane in PowerPoint to include details about each slide. In your presentation, be sure to include the following:

  • Assessment of appropriate responses to subpoenas and court orders. Include a discussion on the elements that make subpoenas and court orders valid.
  • Differentiation of the elements of private, public, and civil law.
  • Interpretation of the impact of federal regulations on health information management functions and processes. Include specific regulations that impact health information.
  • Title slide and reference slide in APA format.
